Who we are
This website is operated by Oliver Furniture LLC, a Florida limited liability company with its place of business at 15805 Biscayne Blvd, Suite 311, North Miami Beach, FL 33160, United States. In this policy, "Oliver", "we", "us" and "our" mean Oliver Furniture LLC.
Oliver Furniture LLC is the controller of the personal information described here. Where this policy refers to our affiliated manufacturing operation in Brazil, that operation processes information on our instructions in connection with the production of ordered work.
Information we collect
When you contact us through this website, by email or by phone, we collect the information you choose to give us. That normally includes your name, email address, phone number, the company or practice you represent, the type of work you are enquiring about, the location of the project, your target completion date and anything you write in your message.
If you become a client, we additionally collect the information needed to design, quote, manufacture and install the work. That includes the project address, site measurements and photographs, architectural drawings you provide, finish selections, delivery and access arrangements, and billing details.
We also collect limited technical information automatically, including your IP address, browser and device type, the pages you view, the time of your visit and the site or search that referred you. Beyond what is strictly necessary to serve the page securely, this is collected only where you have accepted analytics cookies.
We do not intentionally collect special categories of personal data, and we ask that you do not send them to us.
How we use it
We use the information you send us to respond to your enquiry, prepare a quotation, arrange a showroom visit, and design, manufacture, deliver, install and warranty your project if you become a client. We use it to invoice you and to keep the accounting and tax records we are required to keep.
We use technical information to keep the site secure and to understand how it is used so we can improve it.
We may use photographs of completed work for our portfolio and marketing. Where a project is identifiable, we seek the client's permission before publishing.
We do not sell your personal information, and we do not share it for cross-context behavioural advertising. We do not use it for automated decision making or profiling that produces legal or similarly significant effects.
Legal bases for processing
Where the GDPR or the LGPD applies to our processing, we rely on the following bases. We process enquiry and project information because it is necessary to take steps at your request before entering a contract, and to perform that contract once it exists. We process analytics information on the basis of your consent, which you give through the cookie banner and may withdraw at any time. We retain records for accounting and tax purposes because we are under a legal obligation to do so. We rely on our legitimate interest in keeping our site secure and our records accurate, where that interest is not overridden by your rights.
Cookies and analytics
Cookies and similar storage that are strictly necessary for the site to function are always active. This includes the record of your own cookie choice, which we store in your browser so that we do not ask you again on every page.
Analytics and marketing cookies are set only if you accept them in the cookie banner. If you reject them, they are not set. You can change your choice at any time by clearing this site's storage in your browser and making a new selection, or by contacting us using the details below.
Some browsers send a Global Privacy Control signal. Where a US state law requires us to honour that signal as an opt-out, we treat it as one.
Third parties
We use a small number of service providers to run this website and our business. Each acts on our instructions and is not permitted to use your information for its own purposes.
Our website is hosted by Netlify, Inc. in the United States. Our business email and document storage are provided by Google LLC through Google Workspace. Contact form submissions are processed by Formspree, Inc. in the United States and delivered to our email. If analytics are enabled and you have consented, they are provided by Google LLC through Google Analytics.
We may also disclose information to our professional advisers, to payment and banking providers, and to public authorities where we are legally required to do so.
International transfers
Oliver Furniture LLC operates in the United States. Our affiliated manufacturing operation is in Brazil, and information necessary to produce your project is transferred there. Your information may therefore be accessed by our team in either country.
For transfers of personal data out of the European Economic Area or the United Kingdom, we rely on the European Commission's Standard Contractual Clauses, together with the UK Addendum where relevant. Brazil has been recognised by the European Commission as providing an adequate level of protection. For transfers of personal data out of Brazil, we rely on the international transfer mechanisms permitted under Articles 33 to 36 of the LGPD.
How long we keep it
We keep enquiry information from people who do not become clients for 24 months from our last contact with you, after which we delete it.
We keep client project records, including drawings, specifications and photographs of completed work, for 10 years from installation. This reflects the period during which questions about the work, its warranty and its repair can reasonably arise.
We keep accounting and tax records for 7 years, as required by US federal and Florida law.
Analytics data is retained for 14 months. Records of your cookie choice are stored in your own browser until you clear them.
Your rights
Depending on where you live, you may have the right to request a copy of the information we hold about you, to have it corrected, to have it deleted, to restrict or object to how we use it, to receive it in a portable format, and to withdraw any consent you have given without affecting processing already carried out.
If you are in Brazil, these rights arise under Article 18 of the LGPD, and you also have the right to confirm that processing is taking place, to learn with whom we have shared your data, and to be informed of the consequences of refusing consent. If you are in the European Economic Area or the United Kingdom, these rights arise under the GDPR.
To make a request, email us at the address below. We may need to verify your identity before we act. We will respond within 30 days, or within 15 days where the LGPD requires it, and we will tell you if we need longer.
If you are not satisfied with our response, you may complain to your supervisory authority. In Brazil this is the Autoridade Nacional de Proteção de Dados. In the European Economic Area or the United Kingdom it is your national data protection authority.
Additional rights for US state residents
If you are a resident of California, Colorado, Connecticut, Virginia, Utah, Texas, Oregon, Montana or another state with a comprehensive consumer privacy law in force, you may have the right to know what personal information we have collected about you, to access and delete it, to correct inaccuracies, to obtain a portable copy, and to opt out of sale, sharing and targeted advertising.
We do not sell personal information and we do not share it for cross-context behavioural advertising, so there is nothing to opt out of in those categories. We will not discriminate against you for exercising any of these rights. You may use an authorised agent to make a request on your behalf, and we may ask that agent for proof of their authority.
In the 12 months before the date of this policy, we collected the categories of information described above under "Information we collect", for the purposes described under "How we use it", and disclosed them only to the service providers named under "Third parties".
Children
This website is not directed at children. We do not knowingly collect personal information from anyone under 13, or under 16 in jurisdictions that set that threshold. If you believe a child has given us information, contact us and we will delete it.
Security
We use technical and organisational measures appropriate to the risk, including encryption of the site in transit, access controls on our systems and limiting access to the staff who need it. No method of transmission or storage is completely secure, and we cannot guarantee absolute security. Please do not send us sensitive documents by unencrypted email; ask us for a secure upload link instead.
Changes to this policy
We may update this policy as our practices or the law change. The current version is always the one published on this page, and the date at the top tells you when it last changed. Where a change materially affects your rights, we will take reasonable steps to notify you.
